Omaha First-Time DUI Lawyer

Lexington first-time driving under the influence lawyer

Douglas County Attorney for Clients Facing Their First Drunk Driving Charge in Nebraska

A lifetime's worth of good driving habits and decisions can be nullified in an instant when you are arrested for driving under the influence. A DUI charge and conviction can leave a lasting stain upon your criminal record, reduce your employability, and make everyday life more difficult.

Olsen Law Offices, P.C., L.L.O. will serve as your legal advocate and fight for the preservation of your driving privileges. Attorney Tom Olsen is a Former Assistant State Attorney General and Assistant Omaha City Prosecutor who has helped thousands of clients charged with DUI achieve a favorable outcome. With three decades of trial experience, he is the criminal defense attorney to have by your side.

First-Time DUI Charges

Any driver cited for their first DUI is subject to a Class W misdemeanor charge. While this carries possible jail time of up to 60 days, Attorney Tom Olsen can pursue probation as an alternative, including a mandatory alcohol education program. A conviction will earn a six-month driver's license revocation and a fine of up to $500.

For drivers whose blood-alcohol concentration registers at .15 or above, this is considered aggravated DUI, which comes with harsher penalties including license suspension for up to a year.

Ignition Interlock Permits

First-time DUI offenders can apply for and receive an ignition interlock permit in order to maintain their full driving privileges with the installation of an in-vehicle breathalyzer. The driver must pass a breath test prior to starting the vehicle and at various points during operation. This option is available if an individual waives their right to a DMV Administrative License Revocation (ALR) hearing. It is open to those charged with regular (.08 BAC to .14) and aggravated DUI.

How a DUI Lawyer Can Help

If the police had no legitimate reason to pull you over, Attorney Tom Olsen will file a motion to suppress all evidence obtained from the unlawful traffic stop. He can also pursue dropped charges if police improperly administered your field sobriety or BAC tests, if they failed to follow the 15-minute observation protocol prior to testing you at the police station, or if testing equipment was improperly maintained.

Attorney Olsen will determine if any of these occurred with a complete investigation of your case. If a conviction can be avoided, he will find the way. Along with knowing what drivers should do if pulled over for DUI, with his three decades of legal experience, he also knows how to achieve the best possible result in every case.
